- HOW TO ENTER: The Sweepstakes will run during the period commencing on 12:01 AM EST November 30, 2009 and ending at 11:59 PM EST December 13, 2009. To enter, go directly to www.marthasnf.com or any of the participating stations’ websites: www.nbcnewyork.com, www.nbcla.com, www.nbcchicago.com, www.nbcphiladelphia.com, www.nbcdfw.com, www.nbcbayarea.com, www.nbcmiami.com, www.wbaltv.com, www.nbcsandiego.com, www.kcra.com, www.wlwt.com, locate and then click on the “Martha’s Sunday Night Football Sweepstakes” (the “Sweepstakes”) banner or link. Follow the on-screen instructions for Sweepstakes entry details. Complete the entry form including email address, name, complete address, gender, date of birth, telephone number(s) (“required information”). Once completed, click on the “Enter Now” button to submit your entry. You will be automatically entered into the random Grand Prize drawing in your television designated market as well as the First Prize sweepstakes overlay (the “Sweepstakes Overlay”) drawing for eligible entrants in all participating markets. After you have entered the Sweepstakes, you may refer up to five (5) different friends, by providing their email addresses on the thank you page, to tell them about the Sweepstakes. Each eligible friend you refer will be sent an email on your behalf, providing him/her the opportunity to enter the Sweepstakes. For each unique friend you refer that completes the required information, you will receive an additional bonus entry. For purposes of these Official Rules, all times and dates are Eastern Standard Time. No purchase is necessary to enter the Sweepstakes. All entries and related correspondence become the property of NBC Universal, Inc. and The Martha Stewart Show (collectively "Sponsors"), the NFL Entities (as defined below) and its Promotional Partners (as defined below) and will not be acknowledged.
Participants are limited to two entries per email per day. Additional entries will be disqualified, as will all incomplete entries and all entries not received within the Entry Period. Sponsors, Administrator, and Delta Vacations and any other partners (collectively, “Promotional Partners”) are not responsible for any electronic miscommunications or failures, technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed telephonic transmissions which may limit an entrant’s ability to participate in this Sweepstakes. Use of any automated system or sweepstakes entry service or mechanism to submit entries/place calls is prohibited and will result in disqualification. Normal Internet access and usage charges imposed to your on-line service will apply. It is the sole responsibility of the entrant to notify the Administrator in writing of email address changes or any other information on Entry Form by mailing a postcard to: “Martha’s Sunday Night Football Sweepstakes”,” c/o MerryMedia, Inc., 4370 Tujunga Ave., Suite 320, Studio City, CA, 91604.
- ELIGIBILITY: Entrants must be permanent, legal residents of the 50 United States (including the District of Columbia but excluding Puerto Rico and all other U.S. and foreign territories and possessions and all areas where this Sweepstakes is prohibited by federal, state, provincial, municipal or local law), must be physically present in the U.S. as of the date of entry through and including the date of awarding of the Sweepstakes prizes, and must be 18 years or older on the date of entry. Employees of the NFL Entities (as defined below), Sponsors, Administrators, Promotional Partners, and their parent, subsidiary, affiliated and joint venture companies, and any advertising and promotion agencies or any other entity involved in the development or administration of this Sweepstakes, as well as members of such employees’ immediate families and households (including children, spouses and siblings and/or other people living in the same households as such persons, whether related or not), are not eligible to participate.
- CONDITIONS OF PARTICIPATION/ENTRANT RELEASES: By entering this Sweepstakes, entrants agree to be bound by these Official Rules including all eligibility requirements and to comply with all applicable federal, state and local laws and regulations. Entries made by any mass duplication, automatic, robotic, or programmed method, through any sweepstakes entry, notification or related service, or in any manner not in compliance with the requirements of these Official Rules are invalid and will be disqualified. Lost, incomplete, late, inaccurate, garbled, and/or damaged entries are void. Entry materials that have been tampered with or altered are void. Entrant unconditionally assigns and transfers to Sponsors all rights, title, interest, and claims that (s)he now has, or may in the future have, to his/her entry. Sponsors, and/or its Promotional Partners and Administrators have the right to use, assign or dispose of such entries however they deem to be appropriate without the approval of, or compensation to, entrants or any third party(s). Sponsors, Sponsors' Promotional Partners, Administrators and any telephone network, cable television, ISPs or other service providers, and their respective parent, affiliated companies, employees, officers, directors, shareholders, agents, and attorneys are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect or failure of any telephone network, computer equipment, or software (including, without limitation, any damage to entrant's or any other person's computer hardware or software resulting from the participation in the Sweepstakes or access to or downloading of materials from the Website), for the inability to access any online service or the Website, or any other error or malfunction.
Unless prohibited by law, entry into this Sweepstakes and/or acceptance of any prize constitutes permission for Sponsors and their Promotional Partners to use, without additional compensation, worldwide and in perpetuity in any and all forms of media, now known and hereafter devised, for promotional, publicity, and public relations purposes associated with the Sweepstakes including without limitation, online (including, without limitation, posting on a website(s) any winner’s or participant’s name, photo, likeness, biographical information, statement, voice and/or address {city and state}). By participating, entrant (i) agrees to release and hold the NFL Entities (as defined below), Sponsors, Administrators, the Promotional Partners, their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the “Released Parties”), harmless against any and all claims and liability of any kind (including, without limitation, personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy) arising in whole or in part, directly or indirectly, out of participation in the Sweepstakes or the acceptance, possession, misuse, nonuse or use of any prize (including any travel or activity related thereto); (ii) waives all rights to claim direct, indirect, punitive, incidental and consequential damages, attorney’s fees or any damages of any kind; (iii) agrees to be bound by these Official Rules and the decisions of the Sponsors and its representatives, which are final and binding on all matters relating to the Sweepstakes, and (iv) agrees to waive any right to claim any ambiguity or error in these Official Rules, or the Sweepstakes itself.
- GRAND PRIZES: Eleven (11) GRAND PRIZES consisting of a trip for each grand prize winner and one (1) guest to New York (the “Trip”) to see The Martha Stewart Show (the “Prize Event”). Each Trip includes: round-trip coach airfare for one (1) grand prize winner and one (1) guest provided by Delta Vacations between the major airport closest to grand prize winner’s home, as determined by Sponsors in their sole discretion, and New York City; three (3) days, two (2) nights standard double occupancy hotel accommodations, as determined by Sponsors in their sole discretion; and one hundred dollars ($100) in the form of a check made payable to the grand prize winner or in such other form as designated by Sponsors in their sole discretion. One (1) of each of the GRAND PRIZE trips will be given away to entrants residing in the terrestrial viewing areas of the following Television Designated Market Areas: New York, Los Angeles, Chicago, Philadelphia, Dallas, San Francisco, Miami, Sacramento, San Diego, Cincinnati and Baltimore. All grand prize winners will be offered the opportunity to attend a taping of The Martha Stewart Show in New York City. Production dates are subject to change without prior notice. Actual value of a trip depends on dates of travel and winner’s residence or departure city. An IRS 1099 will be issued to winners. Roundtrip airfare valued up to $300 per person; maximum value of hotel accommodations is $600. Approximate retail value of each Grand Prize (“ARV”): $1,300. Total ARV for Grand Prizes: $14,300.
- SWEEPSTAKES OVERLAY FIRST PRIZE: One (1) FIRST PRIZE trip for one (1) first prize winner and one (1) guest (the “First Prize Trip”) to attend a taping of the Sunday Night Football pregame show and to attend a taping of The Martha Stewart Show in New York City (collectively the “Prize Events”). Production dates are subject to change without prior notice. The FIRST PRIZE Trip consists of round-trip coach airfares for one (1) first prize winner and one (1) guest provided by Delta Vacations between the major airport closest to first prize winner’s home, as determined by Sponsors in their sole discretion, and New York City; five (5) days, four (4) nights standard double occupancy hotel accommodations, as determined by Sponsors in their sole discretion; and one hundred dollars ($100) in the form of a check made payable to the grand prize winner or in such other form as designated by Sponsors in their sole discretion. ARV of Sweepstakes Overlay First Prize:$2,300. Actual value of a trip depends on dates of travel and winner’s residence or departure city. An IRS 1099 will be issued to winners. - RUNNER UP PRIZES: One (1) runner up will be chosen in each of the eleven (11) markets: New York, Los Angeles, Chicago, Philadelphia, Dallas, San Francisco, Miami, Sacramento, San Diego, Cincinnati and Baltimore will receive one (1) copy of Martha Stewart’s book, Dinner at Home, with a retail value of $35 per, and one (1) small football with a retail value of $20 per, autographed by any NBC sportscaster as designated by Sponsors in their sole discretion. ARV of one Runner-Up prize: $55. Total ARV combined: $605.
ARV of all prizes combined: $17,205.
- GRAND PRIZE AND FIRST PRIZE ELIGIBILITY AND RESTRICTIONS: The Trip awarded to the Grand Prize Winners and First Prize Winner must be taken within dates provided by the Sponsors or that portion of the Grand Prize/First Prize will be forfeited. Travel arrangements must be made through Delta Vacations. Certain travel restrictions and black out dates may apply. Grand Prize Winner and guest, and First Prize Winner and guest must travel together on the same itinerary, including the same departure date, destination and return date, and must have valid travel documents (e.g., valid government issued photo I.D. and/or passport) prior to departure, and failure to do so will result in forfeiture of prize. Grand Prize Winners and First Prize Winner and guests must be at least 18 years old. Once travel commences, no unscheduled stopovers are permitted; if an unscheduled stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. Sponsors are not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. All travel and lodging will be at the risk of winner and guest. Guest must complete a travel guest liability/publicity release prior to the Trip, or this portion of the prize may be forfeited. Trip must be taken on dates designated by Sponsors, and all travel must be completed by December 1, 2010. Winner and his/her guest must abide by all rules and restrictions and are solely responsible for satisfying all legally required conditions of travel.
Grand Prize Winners and First Prize Winner are solely responsible for all expenses and costs associated with acceptance and/or use of the prize not specifically stated herein as being awarded, including, without limitation, any and all federal, state and local taxes, travel from winner’s residence to and from airport, ground transportation, travel insurance, security and airport fees, taxes, insurance, gasoline, meals, gratuities, and souvenirs. All prize details are at the sole discretion of the Sponsors. If Grand Prize Winners or First Prize Winner cannot accept prize (or any portion thereof) as stated, prize will be forfeited and at Sponsors’ discretion, and an alternate winner may be selected. Sponsors will not replace any lost or stolen tickets, travel vouchers or certificates. In the event that access to the Prize Event(s) are not available for any reason, or in the event that any prize component is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsors’ prize obligation to winner and no additional compensation will be awarded. No cash or other substitution, assignment or transfer of any prize permitted (except at the Sponsors’ sole discretion), who reserves the right to substitute a prize (or any component thereof) with another of comparable or greater value.
- Winner Notification: On or before December 20, 2009, eleven (11) Grand Prize Winners, one (1) First Prize Winner and eleven (11) Runner-up Winners will be randomly chosen from the eligible online entries received during the Sweepstakes period by an independent administrator and all decisions will be final and binding. All Potential Winners will be notified by the telephone and/or by email. Two (2) attempts will be made to contact the winners within 72 hours from the time of the winners’ selection. If administrator is unable to reach a potential winner within this period, he/she may be disqualified and an alternate may be selected, in Sponsors’ sole discretion. Each Winner will be required to complete, sign, and return the Eligibility, Liability and Publicity Release ("Release") (unless prohibited by law) by January 30, 2010. If the Release is not returned within such time period, the prize may be forfeited and an alternate winner may be selected from among all eligible non-winning entries received. If any prize notification, communication or correspondence of any kind or any prize is returned as undeliverable, the corresponding prize will be forfeited and may be awarded to an alternate winner, in Sponsors’ sole discretion.
- Reservation of Rights; Limitation of Liability: Sponsors reserve the right to cancel, terminate or modify this Sweepstakes in the event that this Sweepstakes is not capable of being conducted or completed as planned for any reason including, without limitation, as a result of computer virus(es), bugs, tampering, or technical failures of any kind. In the event of cancellation, Sponsors reserve the right, at their sole discretion, to pick winner(s) in a random drawing (or using any other method, in Sponsors’ discretion) from among all eligible entries received by Sponsors up until the time of such cancellation, termination, modification or suspension, as applicable. If the Sweepstakes is cancelled or terminated, notification will be posted on the Sweepstakes Website. In the event of a dispute as to the identity of an e-mail entrant (as applicable), the Authorized Account Holder of the e-mail address submitted/used at time of entry will be deemed to be the entrant. “Authorized Account Holder” means the natural person to whom the e-mail address is assigned by an internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. A potential winner may be required to provide proof to Sponsors and/or its agents that he or she is the Authorized Account Holder of any e-mail address associated with a potential winning entry. Sponsors reserve the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If disqualified, Sponsors reserve the right to terminate entrant’s eligibility to participate in this Sweepstakes. ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY PERSONS RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If any provision of these Official Rules is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from these Official Rules and shall not affect the validity and enforceability of the remaining provisions. The failure of the Sponsors, Promotional Partners and/or Administrators to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside the control of either (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
- Governing Law: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant or Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. AN ENTRANT AGREEs THAT If any controversy or claim arising out of or relating to THESE official RULES, the breach of any term hereof, or ENTRANT’S participation in connection with the CONTEST cannot be settled through direct discussions, THE ENTRANT OR SPONSORs shall endeavor first to settle the controversy or claim by mediation conducted in the CITY OF NEW YORK and administered by JAMS under its applicable rules. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, ENTRANT OR SPONSORS agree that it shall THEN be resolved by FINAL AND binding arbitration conducted in the CITY OF NEW YORK, and administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (the “JAMS Rules”, available at www.jamsadr.com, including, without limitation, the rule providing that each party shall pay pro rata its share of jams fees and expenses, and the rules providing for limited discovery and other exchange of information). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an arbitrator licensed to practice law in NEW YORK OR A RETIRED JUDGE. Notwithstanding the above requirements, if any party files suit in court, or files an arbitration before first seeking to mediate, in direct violation of this paragraph, the other party NEED NOT request mediation to enforce their right to compel arbitration. any mediation OR arbitration proceedings, testimony, OR discovery, along with any documents filed or otherwise submitted in the course of any such proceedings (and including the fact that the mediation or arbitration is even being conducted), shall be confidential and shall not be disclosed to any third party except to the mediators or arbitrators and their staff, the parties’ attorneys and their staff, and any experts retained by the parties. If any portion of the dispute resolution mechanism set forth HEREIN is found to be invalid, illegal or unenforceable for any reason, that portion shall be severed from the rest and shall not affect YOUR agreement to resolve all controversies and claims through mediation and arbitration.
- The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “NFL Entities”) will have no liability or responsibility for any claim arising in connection with participation in this sweepstakes or any prize awarded. The NFL Entities have not offered or sponsored this sweepstakes in any way.
